Terms of Use
1. Purpose
These terms of use ("Terms") govern access to and use of the Crawlswarm service (the "Service"), published by Kevin Lefebvre EI. The Service enables the collection of publicly available information about professional establishments via Google Maps and its enrichment with third-party sources.
Access to the Service requires prior registration and, during the beta phase, a named invitation issued by the publisher.
2. Access conditions
The Service is exclusively intended for professionals (B2B) acting in the course of their business activity. Creating an account requires a valid email address and acceptance of these Terms and the privacy policy.
The user warrants the accuracy of the information provided and undertakes to keep it up to date. Any account may be suspended without notice in the event of fraudulent use or use contrary to these Terms.
3. Description of the Service
Crawlswarm automates the collection of prospects from Google Maps. For each task launched, the Service:
- · queries Google Maps with a business category and a geographic zone;
- · extracts publicly displayed information (name, address, phone, website, reviews);
- · optionally enriches the record via sources selected by the user: the establishment's website (email, phone, social networks, SIREN), and the recherche-entreprises.api.gouv.fr API (headcount, decision-makers).
Collected data belongs to the user once surfaced in their dashboard. The publisher does not use it for any purpose other than providing the Service.
4. Credit model
Each lead surfaced in the dashboard consumes:
- · 1 base credit per Google Maps record inserted;
- · a variable surcharge per enrichment module only if the data is actually found. Surcharge details are shown in the form at the time of launch.
Requested but unsuccessful enrichments are not billed. An in-progress task can be stopped at any time from the dashboard: leads already collected are retained and credits stop being consumed.
The monthly quota and its reset point are visible in the Usage section of the dashboard.
5. User obligations
The user undertakes to:
- · comply with GDPR and applicable legislation on commercial prospecting (opt-in required for B2C, opt-out for B2B by sector);
- · use collected data solely for legitimate commercial prospecting directed at legal entities;
- · maintain a record of processing activities where required by GDPR Article 30;
- · respond within legal timeframes to any data subject rights requests;
- · not attempt to circumvent the Service's technical limits or automate access outside of official integrations.
6. Availability and SLA
The Service is provided as-is, without any guarantee of availability or results during the beta phase. The publisher endeavors to maintain reasonable availability but may suspend the Service at any time for maintenance, without notice. No contractual SLA applies during the beta phase.
7. Intellectual property
The source code, interface, trademarks, and logos of the Service remain the exclusive property of the publisher. The user is granted a personal, non-exclusive, non-transferable right of use for the duration of their subscription. Data collected via the Service remains freely usable by the user without restriction.
8. Liability
The publisher does not guarantee the completeness or absolute freshness of data displayed by Google Maps or third-party sources. It is the user's responsibility to verify information before any sensitive commercial use (mass mailings, legally constrained prospecting).
The publisher shall not be liable for use of data that does not comply with applicable legislation, nor for indirect damages (loss of revenue, reputational harm, etc.).
9. Termination
The user may cancel their account at any time from the Settings interface. Their personal data will then be deleted within 30 days, with the exception of billing data retained for the legally required period (10 years).
The publisher may terminate an account without notice in the event of a serious breach of these Terms, in particular misuse of extracted data contrary to GDPR.
10. Modifications to the Terms
The publisher reserves the right to modify these Terms at any time. Users will be notified of any material change by email at least 15 days before it takes effect. Continued use of the Service after that date constitutes acceptance of the new terms.
11. Governing law and jurisdiction
These Terms are governed by French law. Any dispute relating to their interpretation or performance will be submitted to the competent courts of the publisher's registered office, unless a mandatory legal provision provides otherwise.
